Brown's Lawyer to File Motion to Dismiss the Case

Thursday, April 30 2009

by Joe Halls

Mark Geragos, Chris Brown's lawyer plans to file a motion that will dismiss the assault case against his client. The main reason was due to the leakage of Rihanna's photo on the internet showing the singer’s bruised face, which Geragos attributed as police’s fault.

However, L.A. criminal defense attorney Jeffery Rubenstein commented, "If Geragos makes an issue of leaked evidence, it's unlikely the judge will dismiss the case. It's not police conduct at issue here, it's Chris Brown's."

Just recently, L.A. Superior Court Judge Patricia Schnegg approved Geragos' request to delay the case moving the next hearing to May 28. The next phase of the case is to set a preliminary hearing. In that way, the court will decide if the evidences are sufficient to proceed with a trial.
